Affiliate program agreement

The terms “affiliate,” “you,” and “your” refer to you, whether an individual or legal entity, applying to or participating in the FireVM Affiliate Program. The terms “we,” “us,” and “our” refer to FireVM Web Solutions, also referred to as “FireVM” or “FireVM.com.”

1. Affiliate program terms

This affiliate program agreement is a legal contract between you and FireVM governing your participation in FireVM’s affiliate program. By registering for or participating in the program, you agree to be bound by this agreement. If you do not agree, you must not enroll or must immediately cease participation and remove all FireVM affiliate links and marketing materials.

FireVM reserves the right to approve or reject any affiliate application at its sole discretion. FireVM may also terminate this agreement at any time if your website or promotional methods are deemed unsuitable.

Unsuitable content includes, but is not limited to:

  1. Discriminatory material based on race, nationality, gender, sexual orientation, religion, disability, or age
  2. Sexually explicit, pornographic, or obscene content
  3. Content promoting illegal activity
  4. Harmful, defamatory, harassing, or offensive material
  5. Promotion of alcohol, tobacco, firearms, gambling, drugs, or violence
  6. Any unlawful, unethical, or misleading behavior
  7. Content misaligned with FireVM’s brand values

2. Modification of terms

FireVM reserves the right to modify or update this agreement at any time at its sole discretion. Continued participation in the affiliate program constitutes acceptance of any changes.

3. Commission structure

Commission rates vary depending on the product or service purchased by the referred customer. Commissions apply only to FireVM shared hosting, reseller hosting, VPS hosting, cloud hosting, and dedicated server services.

To qualify for commission credit, all of the following conditions must be met:

  1. The customer must be a new, first-time FireVM customer referred through your unique tracking link
  2. The hosting service must remain active and in good standing for at least 90 consecutive days
  3. The account must not be canceled, refunded, charged back, or delinquent during the qualification period
  4. Your affiliate tracking link must remain functional and unmodified

4. Commission disbursement

Commissions become eligible for withdrawal once your account balance reaches USD 100. Eligible affiliates must request payout manually. Approved commissions not withdrawn within two years from the date of sale will be forfeited.

All commissions are issued in U.S. dollars. Affiliates are solely responsible for any applicable taxes, fees, or currency exchange costs.

5. Commission adjustments and reversals

FireVM reserves the right to reverse commissions under the following circumstances:

  1. The referred service is canceled within 90 days
  2. The hosting account does not remain active for 90 consecutive days
  3. The customer downgrades their service or billing frequency
  4. The transaction is fraudulent or based on false information
  5. A chargeback or payment dispute occurs
  6. The referral originates from the same IP address as the affiliate

6. Affiliate program restrictions

Violation of any of the following conditions will result in immediate termination of affiliate status and forfeiture of unpaid commissions:

  1. Self-referrals are strictly prohibited
  2. Affiliates may not bid on FireVM-branded keywords, including “FireVM” or “FireVM.com”
  3. Use of FireVM brand names, variations, or misspellings in paid advertisements is not permitted
  4. Affiliates may not misrepresent their relationship with FireVM
  5. Spam, unsolicited bulk email marketing, or deceptive promotional practices are strictly prohibited

7. Independent contractor status

Participation in the FireVM Affiliate Program does not create a partnership, joint venture, agency, or employment relationship. Affiliates are not authorized to make representations or commitments on behalf of FireVM.

8. Limitation of liability

FireVM shall not be liable for indirect, incidental, special, or consequential damages, including loss of revenue, profits, or data, arising from participation in the affiliate program. FireVM’s total liability under this agreement shall not exceed the total commissions paid to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless FireVM, its officers, employees, affiliates, and agents from any claims, losses, damages, liabilities, or expenses, including reasonable attorney fees, arising from your participation in the affiliate program or violation of this agreement.

10. Dispute resolution and arbitration

By participating in FireVM’s affiliate program, you agree that all disputes related to this agreement shall be resolved through binding arbitration administered by FireVM. The arbitrator’s decision shall be final and binding, except as required by applicable law.

11. Disclaimer

FireVM makes no guarantees regarding potential earnings through the affiliate program. We are not responsible for service interruptions, tracking failures, or technical issues that may affect commission reporting or payouts.
