Terms of service

Carefully examine this agreement to understand the essential terms concerning your rights and legal recourse.

1. Content

All services provided by FireVM must be utilized exclusively for lawful purposes. The transmission, storage, or display of any information, data, or materials violating United States federal, state, or local laws is strictly prohibited. This includes but is not limited to copyrighted content, threatening or obscene material, content that compromises national security, or any material protected by trade secrets or other intellectual property laws. Subscribers agree to indemnify and hold FireVM harmless from any claims or liabilities resulting from their usage of FireVM’s services, which cause harm or damage to the subscriber or third parties.

2. Explicit adult content not permitted

Hosting websites featuring pornography or sex-related merchandise is strictly prohibited on FireVM servers. Additionally, hosting sites containing explicit nudity or linking to such content hosted elsewhere is forbidden.
Exception: Adult websites without explicit nudity and without sex-related merchandise are permitted. Examples include adult dating sites, adult clubs & bars, etc.

3. Examples of prohibited content or links include (but are not limited to)

  1. Adult sites
  2. Warez sites
  3. PHP shells
  4. Proxy scripts
  5. Gambling sites
  6. Torrents & P2P
  7. Carder sites or forums
  8. Unlicensed banking sites
  9. Ponzi/pyramid schemes
  10. Phishing & fraudulent sites
  11. Racism, violence, hate sites
  12. Child pornography of any sort
  13. Sites selling unlicensed software
  14. Pirated software, IRC software
  15. Hacking sites, programs or archives
  16. Game servers including dedicated game server programs
  17. HYIP sites, HYIP monitors, e-currency exchange sites
  18. Sites distributing hacking tools, data, products or services
  19. Distribution of music files or any other material in which the account holder does not own the copyright

FireVM reserves sole discretion in determining violations of this provision. Non-compliant content may be removed without prior notice.

4. Prohibited file hosting includes

  1. IRC, egg drops, BNC, or IRC bots are strictly prohibited on our network
  2. Files referencing IRC or similar chat applications operating as background processes are disallowed
  3. Proxy servers, regardless of usage type (personal or business), are strictly prohibited
  4. Any form of port scanning conducted from or directed toward our servers and network is prohibited

5. Spam, commercial advertising, and email policies

  1. Spamming: sending unsolicited emails through any FireVM server or network is strictly prohibited. FireVM reserves the exclusive right to determine what constitutes spam, including mail related to opt-in or opt-out programs or indirectly referencing domains hosted by FireVM
  2. Running unconfirmed mailing lists: subscribing email addresses to mailing lists without explicit, verifiable consent from email owners is prohibited. Mailing lists operated by FireVM customers must adhere to closed-loop (“confirmed opt-in”) protocols. Proof of subscription confirmations must be retained indefinitely. Purchasing third-party email lists for mailings related to FireVM-hosted domains or accounts is prohibited
  3. Commercial/mass mailing: any type of mass mailing, including commercial advertisements, is strictly prohibited, regardless of recipients’ consent
  4. Blacklisting of website/server IPs: if your website or server IP addresses become blacklisted due to abusive activities such as spamming, hacking, or phishing, your service may be terminated without notice or refund. Blacklist status will be verified using MxToolbox.com and multirbl.valli.org
  5. Advertising, distributing, or facilitating software, programs, products, or services designed to breach this Acceptable Use Policy (AUP) or the AUP of other internet service providers, including but not limited to unsolicited bulk emails, pinging, flooding, mail-bombing, or denial-of-service attacks, is strictly prohibited
  6. Collection of email addresses without explicit consent from the email owners is strictly forbidden
  7. Operating or reselling services connected to individuals or entities listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org is strictly prohibited
  8. Shoutcast servers: due to bandwidth and performance concerns, ShoutCast servers are not permitted

6. Background running programs

All services provided by FireVM must be utilized exclusively for lawful purposes. The transmission, storage, or display of any information, data, or materials violating United States federal, state, or local laws is strictly prohibited. This includes but is not limited to copyrighted content, threatening or obscene material, content that compromises national security, or any material protected by trade secrets or other intellectual property laws. Subscribers agree to indemnify and hold FireVM harmless from any claims or liabilities resulting from their usage of FireVM’s services, which cause harm or damage to the subscriber or third parties.

7. PHP shell

Usage or storage of PHP shells or similar scripts is prohibited.

8. Backup storage

Personal or semi-dedicated hosting accounts cannot be used for backup or storage purposes, except for a single cPanel backup of the same account. Redundant or multiple backups are not permitted.

9. Media storage

Personal or semi-dedicated hosting accounts may not exceed a total combined storage limit of 5 GB for media files. For larger storage needs, customers should upgrade to VPS, cloud, or dedicated server plans.

10. Email storage

Using personal or semi-dedicated hosting accounts to store emails, attachments, or documents beyond a combined 5 GB limit is prohibited. Larger storage needs require VPS, cloud, or dedicated server solutions.

11. Inode limits

Shared and reseller hosting accounts are limited to 200,000 inodes per cPanel account. Exceeding this limit constitutes a violation of our acceptable use policy and may lead to account suspension. Customers needing more resources should upgrade to a dedicated server, which has no inode restrictions.

12. File download server

Personal or semi-dedicated hosting accounts must not be used as file download servers or transloaders. External servers should be utilized for such purposes.

13. Server abuse

Any activities intended to compromise the security or operational integrity of FireVM servers or negatively impact other subscribers are strictly prohibited, including but not limited to:

  1. Unauthorized server or account access
  2. Unauthorized data access or misuse of services
  3. Vulnerability scanning or probing of systems
  4. Unauthorized tampering, hacking, or breaching of security measures
  5. Transmitting malicious programs, viruses, trojans, worms, or cancelbots
  6. Intercepting or expropriating data or information
  7. Disrupting services through overloading, flooding, mailbombing, or system crashes

Subscribers will be held accountable for all actions performed through their accounts, regardless of who initiates them. Adherence to these policies is mandatory for all FireVM customers.

14. Service level agreement (SLA)

FireVM will employ commercially reasonable efforts to deliver services 24 hours a day, 7 days a week. Clients acknowledge that, from time to time, services may become unavailable or inoperable due to scheduled maintenance or upgrades (“scheduled downtime”), operational malfunctions, or factors beyond FireVM’s control, including failures of telecommunications or digital transmission links, malicious network attacks, network congestion, or other disruptions. FireVM will provide no less than 48 hours’ advance notice for scheduled downtime and will use commercially reasonable efforts to minimize any additional service disruptions. FireVM disclaims liability for downtime resulting from client actions.

15. One-hour guaranteed response time

FireVM maintains continuous monitoring of support tickets. Upon receipt of a new ticket, a support representative will provide an initial response within one hour. This guarantee applies exclusively to technical support tickets and excludes sales, billing, and marketing inquiries. During critical incidents (e.g., hardware failures, DDoS attacks, network outages), the one-hour response standard may be extended to facilitate urgent remediation. Incident status updates and resolutions will be published on our system status page.

16. Money-back guarantee and refund policy

FireVM’s money-back guarantee and refund policy are published on our website. Violation of FireVM’s terms of service voids eligibility for a refund.

17. Limitations on use of server resources

Resource usage limits for hosting accounts are published on FireVM’s website. If an account exceeds these limits, FireVM will issue written notification and grant a seven-day remediation period. During this period, clients should review their website assets, code, and databases to address the overage. If the overage remains unresolved, FireVM may suspend or terminate services and assess an overage penalty based on resource consumption and service impact.

18. Account provisioning, renewal, termination, and billing

Billing is processed upon order placement, irrespective of billing cycle dates. Renewal charges are applied one day before the next billing cycle to ensure service continuity.

19. Account suspension for non-payment

  1. Dedicated servers: Suspension occurs if renewal payment is not received by the due date
  2. Other services: Suspension occurs if payment is not received within two business days of invoice issuance
  3. Clients may incur a reactivation fee of up to $50 to restore suspended services

20. Account termination for non-payment

Accounts with invoices unpaid beyond the designated grace periods—one day for dedicated servers and 14 days for other services—will be terminated, and all account data will be permanently deleted without backup.

21. Immediate termination for chargebacks

Chargebacks initiated through a client’s payment provider (e.g., credit card issuer, PayPal) will trigger immediate termination of the account and irreversible data deletion without backup.

22. Cancellation procedure

Cancellation requests require formal proof of account ownership, such as partial payment information or billing credentials. Requests lacking sufficient verification will not be processed. All cancellation requests must be submitted via the designated cancellation portal.

23. Domain transfer responsibilities

FireVM is not responsible for domain transfer processes. Clients must coordinate transfers with their chosen registrars.

24. Complimentary domain registration

During active promotions, FireVM will register one .com, .net, .biz, .info, .name, .us, or .org domain at no cost for new accounts. This offer applies only to initial registrations; subsequent renewals incur standard fees. The promotion does not apply to existing accounts or orders without a complimentary domain request.

25. Value-added services

Services such as backups and cPanel access are provided as discretionary value-adds. Clients remain solely responsible for maintaining data backups. FireVM disclaims liability for any data loss. cPanel is a third-party service and is not endorsed or supported by FireVM.

26. General terms

  1. FireVM may amend these terms of service at any time without notice
  2. These terms constitute a binding agreement between FireVM and the client
  3. Service initiation constitutes acceptance of these terms
  4. Unspecified matters fall under FireVM’s operational discretion
  5. All fees, except those covered by the 30-day money-back guarantee, are final and non-negotiable
  6. The 30-day guarantee applies only to shared hosting and excludes ancillary services (e.g., domain registration, SSL certificates, dedicated IPs)
  7. Violations may result in immediate termination without notice
  8. FireVM may terminate accounts with 15 days’ notice for any reason

27. Dispute resolution

All disputes will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, governed by California law without choice-of-law provisions. Arbitration hearings will occur in Los Angeles County, California, unless otherwise agreed in writing. Each party bears its own costs. Arbitration awards are enforceable as court judgments in any jurisdiction.

28. Limitation of liability

FireVM’s liability for damages arising from service delivery is limited to the total fees collected from the affected account during the preceding billing period.
